Terms of Use

1. Parties and Subject Matter

These Terms of Use ("Terms") are entered into between Mustafa Kadir Ağca ("we"), who operates the UniQoo mobile application ("UniQoo" or the "App"), and the natural person using the App ("User" or "you").

The Terms set out the conditions under which the App may be used and the mutual rights and obligations of the parties. By creating an account you confirm that you have read, understood and accepted these Terms and the Privacy Policy, which forms an integral part of them. If you do not accept them, you may not use the App.

2. Definitions

• App: the mobile application named UniQoo and all related services.
• User: the natural person who creates an account in the App.
• Content: any post, comment, photo, video, message, event, plan, listing or similar data a User uploads to or creates in the App.
• Club: the paid membership plans the App may offer in the future.

3. Membership and Account

You need an account to use the App. You agree that the information you provide when creating it is accurate, current and your own.

The App is designed for university students. You must be at least 15 years old to hold an account. If you are younger you may not use the App, and we will close any such account we become aware of.

You are responsible for the security of your account and password. Do not share your password with anyone. If you notice unauthorised use of your account, report it to destek@uniqooapp.com immediately. You are responsible for activity carried out through your account unless you prove otherwise.

As a rule one person holds one account. Creating a new account to circumvent a suspension or closure is prohibited.

4. Rules of Use

You agree to comply with applicable law, generally accepted standards of decency and these Terms. The following are strictly prohibited:

• Posts containing insults, threats, harassment, bullying, stalking or hate speech.
• Discrimination or degradation based on race, ethnic origin, religion, language, gender, sexual orientation, disability or similar characteristics.
• Content glorifying violence, encouraging crime or supporting terrorist organisations.
• Obscene, pornographic or sexual material; any content involving the sexual exploitation of children.
• Sharing another person's personal data, photographs or private correspondence without permission.
• Impersonating another person, institution or brand; using a false identity.
• Content infringing copyright, trade marks or other intellectual property rights.
• Trading in narcotics, weapons, forged documents, prescription medicines or other goods whose sale is unlawful.
• Spam, bulk messaging, automated account creation, bots and similar manipulation.
• Spreading misleading information; posts intended for fraud, gambling or pyramid schemes.
• Reverse-engineering the App's source code, attempting to circumvent security measures, introducing harmful software, or degrading the service by overloading it.

5. Content and Intellectual Property

You own the Content you upload. UniQoo claims no ownership of it.

However, so that the service can function, you grant UniQoo a worldwide, royalty-free, transferable licence to store, copy, technically process (for example generate thumbnails or compress), and display and transmit your Content to other users within the limits of the privacy settings you choose. This licence exists solely to provide the service and lasts only while the Content remains in the App; it ends when you delete the Content. Copies that may persist in backup systems for a reasonable period are excepted.

The UniQoo name, logo, interface design, source code and all other elements belonging to the App itself are owned by UniQoo and may not be used without permission.

If you believe your copyright has been infringed, write to destek@uniqooapp.com stating that you are the rights holder, identifying the content in question and providing your contact details.

6. Moderation and Enforcement

UniQoo may review shared text and images using automated moderation tools and, where necessary, human review. This review exists to keep the App safe for everyone and is not guaranteed to catch every violation.

Where content or behaviour breaching these Terms is identified, the following measures may be applied according to the severity of the breach: removal of the content, a warning, temporary restriction of certain features, suspension of the account, or permanent closure.

You can report rule violations to us using the in-app reporting tool. If you wish to object to a measure applied to you, write to destek@uniqooapp.com.

Where conduct constitutes a criminal offence, the relevant information and records are reported to the competent authorities.

7. Events, Plans and Meeting in Person

The App offers features for creating events, making plans and joining them. These events and plans are created by users; UniQoo is not their organiser, host or guarantor.

UniQoo makes no commitment that an event will actually take place, that it will match its description, or that participants have described themselves accurately. Taking reasonable precautions when meeting people you do not know is your responsibility: prefer busy, public places, tell someone you trust where you will be, and leave the moment you feel uncomfortable.

UniQoo cannot be held liable for harm, loss or disputes arising during events and meetings.

8. Marketplace (Second-Hand Listings)

The marketplace section lets users list second-hand items and contact one another. UniQoo is not a seller, buyer, intermediary or broker in these transactions; it merely provides the environment in which listings are published.

Matters such as whether the item matches its description, delivery, payment, defects and returns are entirely between buyer and seller. As UniQoo is not a party to these transactions, it is not liable for disputes or losses arising from them. We recommend not paying before seeing the item and meeting people you do not know in safe locations.

Listing goods whose sale is prohibited or restricted by law is forbidden.

9. Paid Membership (Club)

UniQoo may offer certain features under paid membership plans. If you purchase a paid membership, payment is processed through the infrastructure of the app store you downloaded the app from; your payment details are neither seen nor stored by UniQoo.

The price, duration and scope of a subscription are shown clearly on the purchase screen. Unless stated otherwise, subscriptions renew automatically at the end of each period; you can cancel renewal at any time from the account settings of the relevant store. Cancellation takes effect at the end of the current period.

Refund requests are subject to the refund policy of the store where the purchase was made. Under Turkish distance selling regulations the right of withdrawal may be limited for digital content and services; your rights in this respect are ultimately determined by the applicable legislation.

The features included in a paid membership may change over time. You will be informed a reasonable time in advance of any substantial reduction in scope.

10. Provision of the Service and Changes

UniQoo aims to provide the App without interruption or error but does not guarantee it. Service interruptions may occur due to maintenance, updates, technical faults, problems originating with infrastructure providers, or force majeure.

UniQoo may improve, change or discontinue parts of the App. Changes that substantially affect the user experience are announced in the App.

11. Limitation of Liability

The App is provided "as is". UniQoo gives no warranty as to the accuracy, reliability or lawfulness of user-generated content.

UniQoo is liable only for foreseeable direct damage arising from its own fault. Indirect damage, loss of profit, loss of data and damage arising from the acts of third parties fall outside this scope. This limitation does not affect your rights under consumer legislation that cannot be excluded by contract.

Proof of fault and damage is governed by the general provisions of law.

12. Suspension and Termination

You may delete your account at any time from the Account Info screen in the App. The effect of deletion on your data is explained in the Privacy Policy.

UniQoo may suspend or close your account in the event of a breach of these Terms, unlawful use, or behaviour that threatens the safety of other users. For less serious breaches, a warning is given first where possible.

Termination of an account does not extinguish rights and obligations that arose before it.

13. Changes to These Terms

UniQoo may amend these Terms. Substantial changes are announced in the App before they take effect. Continuing to use the App after such an announcement means you accept the current text. If you do not accept the changes, you may close your account.

14. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Türkiye.

The courts and enforcement offices of İstanbul have jurisdiction over disputes. If you qualify as a consumer, your right to apply to consumer arbitration committees and to the consumer courts of your place of residence is reserved.

15. Miscellaneous

If any provision of these Terms is held invalid, the validity of the remaining provisions is unaffected.

UniQoo's failure to exercise a right under these Terms does not constitute a waiver of that right.

The Turkish text of these Terms prevails. In the event of any discrepancy between the Turkish and any other language version, the Turkish text applies.
